Seller Terms and Product Policy
Applicability
These Terms of service are effective from 2025-05-26 and replace previously published terms.
All sellers on Toybite must agree to these terms and conditions before using the service.
General conditions
Toybite is a marketplace for handmade adult toys and fetish products. Therefore, we only allow products that are made, designed or assembled by you. Generally, everything that is mass-produced or products that you have not made yourself are not allowed on Toybite. Exceptions are toy upgrades and smaller items, such as stickers and shop merchandise.
As a seller, you are responsible for the content and products published on your seller account or in your store. Products, store images, descriptions, and the like must comply with the terms and conditions in this document.
Only individuals, companies and associations from the following countries are allowed to sell on Toybite:
United States, Canada, Australia, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom.
To sell on Toybite you must be 18 years or older.
Toybite reserves the right to review products and to refuse or delete products for any reason, including but not limited to, products violating these Terms of Service, products deemed unsafe, inauthentic, or inappropriate for the platform.
As a platform operator, Toybite is required by law to collect information about all sellers who use the service and report this information to Tax Agencies. Information collected includes name, address, tax registration number, seller's registration number, date of birth or corporate registration number. For EU sellers: sellers who make fewer than 30 sales during a calendar year and for whom the total compensation paid or credited has not exceeded 2,000 euros are exempt.
Fees
As a seller, you agree to pay the platform and transaction fees that apply based on your use of the service. The platform fee is a percentage fee on each sale between seller and customer that Toybite charges as compensation for the seller's use of the service. The transaction fee is a fee that the payment provider (Stripe) charges for each sale. Both the platform and transaction fees are automatically deducted from the order when the seller's customer completes the payment for the order. The fees are:
- Platform fee: 4%, including VAT/tax where applicable, of the total order amount, excluding collected platform fees/taxes.
- Transaction fee: from 1.5% for card payments. Varies according to Stripe's pricing.
If the seller chooses to issue a refund to the seller's customer, Toybite will refund the platform fee charged to the seller in an amount proportional to the amount refunded. For example, if 30% of the order amount is refunded, Toybite will refund 30% of the platform fee charged to the seller. The transaction fee is not refundable.
Platform tax collection
Toybite follows enacted marketplace facilitator laws in several countries and states and will automatically calculate, charge and file VAT/taxes on purchases made from customers in the following countries/regions:
- Norway: when the shop is located outside Norway and the shipping address is in Norway, and if the total order amount is less than or equal to 3000 NOK.
- United Kingdom: when the shop is located outside the UK and the shipping address is in the UK, and if the total value of the package (excluding delivery) is less than or equal to £135. Toybite does not not collect VAT on shipments from the EU to Northern Ireland, or on shipments from Northern Ireland to other parts of the UK.
- All EU countries: when the shop is located outside the EU and the shipping address is in the EU, and if the total value of the package (excluding delivery) is less than or equal to 150€.
If you are located in a country or state not mentioned above you assume responsibility to collect and remit the appropriate amount of sales tax in your jurisdiction.
Toybite cannot provide tax advice and each shop is responsible to research and follow the country/state VAT/tax laws about collecting and reporting VAT/tax based on your location. It is recommended that you consult an accountant or other tax expert in your location to ensure you are following regulations.
When a refund takes place, Toybite will refund the collected tax to the buyer in an amount proportional to the amount refunded.
Payment account and payments
In order to sell on Toybite, a Stripe payment account must be created and linked to your store. When you link such an account, you also agree to Stripe Connected Account Agreement.
When a customer makes a payment to you, the balance is added to your Stripe account. You can choose between daily, weekly, or monthly payouts. A minimum payout amount can be applied, see the Stripe terms.
Before your first payout, Stripe holds the money in your Stripe account for 7 days before you can cash it out to your bank account. For subsequent payouts, your money is held for 3 days from the time you receive the money in your Stripe account until you are able to cash it out. If you have chosen daily payouts, the earnings that were received three days ago are paid out on the current day.
As a seller you are responsible for having enough funds in your account to cover any refunds and chargebacks.
Currencies and exchange rates
A buyer can pay in multiple currencies. A transaction in a currency that is different than your shop currency (or the currency of your connected bank account) results in a currency conversion, and you might receive an amount that is slightly higher or lower than if the transaction was made in your shop/bank account currency.
This also applies to refunds. If a currency conversion takes place when issuing a refund, the amount deducted from your payment account can be larger or smaller than the amount you first received due to currency exchange rates.
Your commitments as seller
Be clear about who you are
To prevent fraud, you must provide, among other things, your correct and complete name, address, email address, and any company name or social security number.
In order for your customers to contact you, you must provide a support email address. This will be displayed on your store page.
Up to four shops
Each seller can create up to four shops. Each store has its own page where the store's products are displayed. It is not allowed to publish the same products in different shops.
One ad per product
Only one active ad is allowed per product. Duplicates will be deleted without notice.
If a product has multiple variations, for example different colors or sizes, these variations should, if possible, be included in the same product ad as variations.
It is not permitted to delete an ad and repost it to gain better visibility, however, if the original ad has been published for more than 14 days, it is permitted to delete it in order to publish a new ad.
Category selection
An ad may not contain multiple products from different product categories. Instead, create separate ads for each category, where each ad contains the product for that particular category. An ad may only be in one category at a time. The ad should be in the category that is most suitable for the product.
Product ad language
Ads must be written in English.
Describe the product clearly
The ad title must describe the product in a clear and concise manner. No unnecessary special characters or similar may be included in the title. The ad text must be relevant to the product. Also remember that you are responsible for everything in your product ad.
Product photos should be well-lit for context, sharp, and clearly show the product.
Do not display genitalia or full nudity photos in product ads. Such content must be censored.
Avoid links in the ad as much as possible; it is not permitted to link to other sales sites, payment functions or the like.
Product titles, product descriptions and store descriptions may not contain someone else's logo, photo or other content that you do not have the right to use.
Origin and manufacturer
As a seller, you should be able to describe or show how and where the product is manufactured.
Services
It is not allowed to sell services on Toybite (not including custom product requests).
Declaration of sale
As a seller, you are responsible to collect tax/VAT (where applicable) and report your income to your local tax agency.
Be active
As a seller, it is important to be active on Toybite. You undertake to keep your products updated, to handle any orders within a reasonable time, and to respond and be helpful to any customers, users, and Toybite staff.
Store terms and conditions and policies
As a seller, you are responsible for specifying both terms and conditions of purchase and privacy policy for your store that describes how you handle returns, exchanges and complaints, as well as how you handle your customers' personal data in accordance with the General Data Protection Regulation (GDPR). The terms and conditions of purchase must comply with the Consumer Purchase Act and the privacy policy must comply with GDPR.
Prohibited goods
Products that are not allowed to be sold in Sweden or your local country are also not allowed to be sold on Toybite. You as a seller are responsible for only selling legal products. The following is a non-exhaustive list of products that are not allowed to be sold on Toybite:
- Any product that is not, or cannot be used with/as, an adult toy or fetish product, or that is not related to these products. Exceptions are toy upgrades and smaller items, such as stickers and shop merchandise.
- Used products, all forms of reselling
- Digital products or content
- Food, drinks and alcohol
- Medicines, herbal remedies
- Drugs, tobacco
- Services, including sexual, escort, massage, or webcam services
- Weapons, weapon parts and ammunition
- Explosive goods or explosives precursors
- Pornography, media depicting nudity or sexual acts
- Health and beauty products
- Live or dead animals
- Fur or body parts from endangered animal species
- Toxic or otherwise hazardous materials or substances
- Offensive content or symbols
Right of withdrawal
Right of withdrawal from Toybite: Individuals usually have a 14-day right of withdrawal when purchasing services remotely. By advertising and selling on Toybite, you waive this right of withdrawal because the service towards Toybite begins immediately when you publish your products. This means that you have no right of withdrawal in the event of a sale where platform and transaction fees are deducted from your balance.
Right of withdrawal towards your customers: If you sell as a company, your customer usually has a 14-day right of withdrawal unless you have stated otherwise. If you sell as a private individual, the right of withdrawal does not apply unless you have stated otherwise. The right of withdrawal does not usually apply to specially ordered goods. You are responsible for specifying your purchase terms in your store settings.
Changes in this Agreement
Toybite reserves the right to change these terms and conditions at any time. Changes to this agreement will be announced in advance before the changes come into effect. By continuing to use the service after a change to the terms and conditions has been made, you also agree to the new terms and conditions. If you do not agree to the new terms and conditions, you are welcome to terminate your account.
This agreement replaces previously published agreements regarding the service by Toybite.
