Seller Terms of Service and Product Policy

Applicability

Toybite's Seller Terms of Service are valid from 2026-10-11 and replace previously published Seller Terms of Service.

These Terms of service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Arctosoft AB ("we", "us", or "our") concerning your access to and use of the https://toybite.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, "Toybite", the "site" or "service").

All sellers ("you") on Toybite approve to these terms by their use of Toybite's services.

General Terms and Conditions

Toybite is a marketplace for handmade adult toys and fetish products. We therefore only allow products that are handmade or largely assembled or created by the seller themselves, or by someone close to them. Generally speaking, mass-produced goods are not permitted on Toybite, nor are products that have not been made by the seller or someone close to them. Exceptions are toy upgrades and smaller items, such as stickers and shop merchandise.

As a seller, you are personally responsible for the content and products published on your seller account or in your shop. Products, shop images, descriptions and similar must comply with the terms and conditions set out in this document.

Only individuals, companies and associations from the following countries are allowed to sell on Toybite: United States, Canada, Australia, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom.

To sell on Toybite you must be 18 years or older.

Toybite reserves the right to review product listings, text and media and to refuse, edit or remove any listings, text and media that breach the terms and conditions of the service.

As a platform operator, Toybite is required by law to collect and verify information about all sellers who use the service, and to report this information to Tax Agencies. The information collected includes, amongst other things, name, address, tax registration number (tax identification number, TIN), the seller's registration number, date of birth or company registration number. Sellers who make fewer than 30 sales in a calendar year and for whom the total remuneration paid or credited has not exceeded 2,000 euros are exempt. For EU sellers: sellers who make 30 or more sales or who sell goods worth more than 2,000 euros per calendar year must provide Toybite with the documents required to verify their identity.

If you violate the terms in this document Toybite reservers the right to limit or close your seller account. Toybite will always contact you when such actions are taken.

Prohibited goods

Products that are not allowed to be sold in Sweden or your local country are also not allowed to be sold on Toybite. You as a seller are responsible for only selling legal products. The following is a non-exhaustive list of products that are not allowed to be sold on Toybite:

  • Any product that is not, or cannot be used with/as, an adult toy or fetish product, or that is not related to these products. Exceptions are toy upgrades and smaller items, such as stickers and shop merchandise.
  • Used products, all forms of reselling
  • Digital products or content, gift cards
  • Food, drinks and alcohol
  • Medicines, herbal remedies
  • Drugs, tobacco
  • Services, including sexual, escort, massage, or webcam services
  • Weapons, weapon parts and ammunition
  • Explosive goods or explosives precursors
  • Pornography, media depicting nudity or sexual acts
  • Health and beauty products
  • Live or dead animals
  • Fur or body parts from endangered animal species
  • Toxic or otherwise hazardous materials or substances
  • Offensive content or symbols
  • Goods that violate or infringe upon copyright, trademark or privacy laws of any jurisdiction

Fees

As a seller, you undertake to pay the platform and transaction fees incurred based on your use of the service. The platform fee is a percentage-based charge on each sale between the seller and the customer, which Toybite charges as remuneration for the seller's use of the service. The transaction fee is a charge levied by the payment provider (PayPal or Mollie) on each sale. The transaction fee varies depending on the payment method and payment provider. Both the platform fee and the transaction fee are automatically deducted from the total order amount once the seller's customer has completed payment for the order. The fees are:

Platform fee

The platform fee is 4%, including VAT where applicable, of the total order amount, excluding collected platform taxes (see next section).

Transaction fee

The current transaction fees can be viewed at PayPal or Mollie. The transaction fees are subject to change at any time, and additional charges may apply in cases such as refunds and disputes.

If, as a seller, you have made a sale via PayPal and you choose to issue a refund to your customer, Toybite will refund you the platform fee that was deducted in an amount proportional to the refunded amount. For example, if 30% of the order amount is refunded, Toybite will refund 30% of the platform fee that was deducted to you. The transaction fee is non-refundable.

If, as a seller, you have made a sale via Mollie and you choose to issue a refund to your customer, Toybite does not refund the platform fee in cash; instead, you will receive the corresponding portion of the platform fee as a credit on your seller account. The credit balance is saved in your account and is automatically used to pay future platform fees when you receive new orders. This means that you pay less (or nothing at all) in platform fees on future sales until the credit balance is used up.

Platform tax collection

We follow enacted marketplace facilitator laws in several countries and states and will automatically calculate, charge and file VAT/taxes on purchases made from customers in the following countries/regions:

  • Norway: when the shop is located outside Norway and the shipping address is in Norway, and if the total order amount is less than or equal to 3000 NOK.
  • United Kingdom: when the shop is located outside the UK and the shipping address is in the UK, and if the total value of the package (excluding delivery) is less than or equal to £135. We do not not collect VAT on shipments from the EU to Northern Ireland, or on shipments from Northern Ireland to other parts of the UK.
  • All EU countries: when the shop is located outside the EU and the shipping address is in the EU, and if the total value of the package (excluding delivery) is less than or equal to 150€.

The tax amount is automatically deducted from the seller's received payment for applicable orders. When a refund takes place, we will refund the collected tax to the buyer in an amount proportional to the amount refunded. If the order was paid with Mollie, we will not refund the platform fee in cash, but instead you will receive the corresponding part of the tax amount as a credit on your seller account. The credit amount is saved in your account and is automatically used to pay future platform fees and taxes when you receive new orders. This means that you pay less (or nothing at all) in platform fees and/or taxes on future sales until the credit amount is used up.

If you are located in a country or state not mentioned above you assume responsibility to collect and remit the appropriate amount of sales tax in your jurisdiction.

We cannot provide tax advice and each shop is responsible to research and follow the country/state VAT/tax laws about collecting and reporting VAT/tax based on your location. It is recommended that you consult an accountant or other tax expert in your location to ensure you are following regulations.

Payment Account and Payouts

To be able to sell on Toybite, you must set up a payment account with PayPal or Mollie and link it to your shop. When you link such an account you also agree to PayPal user agreement and PayPal platform seller account agreement or Mollie's User agreement depending on which payment provider you choose to use. PayPal is available to all sellers. Mollie is only available to business sellers located in the European Economic Area (EEA), Switzerland and the United Kingdom. .

PayPal

When a customer makes a payment to you via PayPal, the order amount is reserved on the customer's payment account or card. Once you have approved the order, the reserved order amount is transferred from the customer to your PayPal account. You can choose between daily, weekly or monthly payouts to your bank account. There may be a minimum payout amount at PayPal. In order to receive payouts from PayPal, PayPal must have verified and approved the details you have provided and your bank account.

In the case of refunds, your PayPal balance may become negative, which means you then owe PayPal money. This amount can be repaid via future orders in your shop, where the negative amount is deducted from the proceeds of the order, or by manually topping up your PayPal account. Any negative balances on your PayPal account must be repaid by you before you can close your shop or your PayPal account.

Mollie

When a customer makes a payment to you via Mollie, the amount is credited to your Mollie account and then paid out to your bank account. A minimum payout amount may apply. If you use daily payouts, you are entitled to five free payouts per month; after that, each payout costs €0.25. Weekly and monthly withdrawals are always free of charge. To be able to receive withdrawals from Mollie, Mollie must have verified and approved the details you have submitted and your bank account.

Depending on the payment method, it takes varying amounts of time for Mollie to transfer funds to your bank account. It usually takes 3-5 working days from the time a payment is received in your Mollie account until it is transferred to your bank account. You can find the current processing times on the page Mollie's processing times.

In the case of refunds, your Mollie balance may become negative, which means you then owe Mollie money. This amount can be repaid via future orders in your shop, where the negative amount is deducted from the proceeds of the order, or by manually topping up your Mollie account. Any negative balances on your Mollie account must be repaid by you before you can close your shop or your Mollie account.

Order processing

When a customer makes a purchase in your shop, they want to be sure that the order will be delivered within a reasonable time. To ensure that you, the seller, have received and reviewed the order, every new order must be approved by you within three days (72 hours) of it being placed (for PayPal payments). This is done on the orders page in 'My Shop'. At least one reminder to approve the order will be sent to you by email.

If the order is not approved within three days of being placed, it will be automatically cancelled. If this happens, the payment transaction will be cancelled, meaning that no purchase has been made. The order will then be considered abandoned. Abandoned orders cannot be reinstated and must not be processed or delivered.

You have the right to cancel or withdraw from an order within three days of placing the order (if the purchase was made using PayPal), unless the order has already been approved. Orders may only be cancelled or withdrawn if you have very good reasons for doing so, for example in the event of illness or if you are otherwise absolutely unable to deliver the order on time. No payment transaction fee or platform fee needs to be paid if the order is cancelled within three days of placing the order (unless the order has been approved).

Regular cancellations or abandoned orders, or any other serious mismanagement of your shop, may result in your shop being closed. Toybite will always contact you at least once before this happens.

A buyer can pay in multiple currencies. A transaction in a currency that is different than your shop currency (or the currency of your connected bank account) results in a currency conversion, and you might receive an amount that is slightly higher or lower than if the transaction was made in your shop/bank account currency.

This also applies to refunds. If a currency conversion takes place when issuing a refund, the amount deducted from your payment account can be larger or smaller than the amount you first received due to currency exchange rates.

Your obligations as a seller

Be clear with who you are

To prevent fraud, you must provide, amongst other things, your correct and full name, address, email address and eventual company name, company registration number or personal identity number.

To enable your customers to contact you, you must provide a valid email address for support. This will be displayed on your shop page. You must monitor the inbox for this email address regularly so that you do not miss any important communications from Toybite or customers.

Up to four shops

Each seller can create up to four shops. Each shop has its own page where the shop's products are displayed. It is not permitted to list identical products in different shops.

One listing per product

Only one active listing per product is permitted. Duplicates will be deleted without warning.

If a product has several variations, such as different colours of the same product, these variations should, where possible, be included in the same product listing as variation options.

It is not permitted to delete a listing and repost it in order to gain greater visibility; however, if the original listing has been published for more than 14 days, it is permitted to delete it in order to publish a new listing.

Choice of category

A listing must not contain multiple products from different product categories. Instead, create separate listings for each category, with each listing containing the product for that specific category. A listing may only appear in one category at a time. The listing must be placed in the category that is most suitable for the product.

Listing language

Product listings must be written in either English or Swedish.

Describe the product clearly

The listing headline must describe the product clearly and concisely. No unnecessary special characters, company names, links or similar elements may appear in the headline. The listing text must be relevant to the product and should describe it. Please also bear in mind that you are personally responsible for everything contained in your product listing. Product text and images must be suitable for all ages.

Product photos should be well lit for the context, in focus and clearly show the product.

Avoid links in listings as far as possible; it is not permitted to link to other sales sites, payment services or similar.

Product headings, product descriptions and shop descriptions must not contain any third-party logos, photos or other content that you do not have the right to use.

Unrealistic/unreliable offers

Product listings and the offers they contain must be realistic.

Origin and manufacture

As a seller, you should be able to describe or demonstrate how and where the product is manufactured.

Services and digital products

It is not permitted to sell services or digital products on Toybite where no physical item is shipped.

Dropshipping

Products may not be sold via dropshipping.

Sales declaration

As a seller, you are responsible to collect tax/VAT (where applicable) and report your income to your local tax agency in accordance with the rules in your specific country.

Be active

As a seller, it is important to be active on Toybite. You undertake to keep your products up to date, to process any orders within a reasonable time, and to respond to and assist any customers, users and Toybite staff.

The shop's terms and conditions and policies

As a seller, you are responsible for setting out both the terms and conditions of sale and the privacy policy for your shop, which set out how you handle returns, exchanges and complaints, as well as how you process your customers' personal data in accordance with the General Data Protection Regulation (GDPR). If you are selling in Sweden, the terms and conditions of sale must comply with the Consumer Sales Act. The privacy policy must comply with the GDPR.

Non-delivered orders

Each customer that orders from you expects the order to be processed and handed over to the courier or the customer within the specified processing time. If an order is not processed or handed over to a courier company or the customer within three working days after the final processing date, the order is deemed a non-delivered order. In the event of a non-delivered order, Toybite is entitled to, on behalf of the seller, refund the customer the full order amount via the payment method or payment service used by the customer during order placement. Toybite will always try to contact you before any refund is made to the customer.

As a seller, you undertake, in the event of a non-delivered order, to ensure that the full order amount is refunded to the customer within a reasonable time, and to pay any fees charged by Toybite or the payment service provider for processing the refund. If it is not possible to refund the customer via the payment method or payment service the customer used when placing the order, you are obliged to refund the customer the full order amount by other means within a reasonable time.

Platform discretion

We reserve the right to deny or remove listings and sellers from the platform for any reason, including but not limited to: if the product or shop is deemed not fitting of the platform, products deemed unsafe or inauthentic or for failing to abide by these rules.

Right of withdrawal

Right of withdrawal in relation to Toybite: Private individuals usually have a 14-day right of withdrawal when purchasing services remotely. By advertising and selling on Toybite, you waive this right of withdrawal, as the service provided by Toybite commences immediately when you publish your products. This means that you have no right of withdrawal in the event of a sale where platform and transaction fees are deducted from your balance.

Right of withdrawal for your customers: If you are selling as a business, your customer usually has a 14-day right of withdrawal unless you have specified otherwise. If you are selling as a private individual, the right of withdrawal does not apply unless you have specified otherwise. The right of withdrawal does not usually apply to made to order or heavily specified goods. You are responsible for specifying your terms and conditions of sale in your shop settings.

Changes to this agreement

Toybite reserves the right to update or amend these terms and conditions at any time. In the event of changes that significantly affect users' rights or obligations, users will be notified in advance before the changes come into effect.

Minor changes that do not affect users' rights or obligations, such as linguistic clarifications, corrections, administrative updates or changes relating to new features and services, may come into effect without prior notice.

By continuing to use the service after the updated terms and conditions have come into force, you accept the updated terms and conditions. If you do not accept the changes, you are entitled to close your account and stop using the service.

This agreement supersedes any previous agreements published by Toybite relating to the service.
